Attorney Fee (How an Attorney is Paid)

The amount an attorney may be paid in a Workers' Compensation case is controlled by the Workers' Compensation Act. No attorney may receive more than 20% of wage loss or medical benefits for their representation in a Workers' Compensation case. The payment of attorney's fees to the attorney is usually automatically deducted from the employee's weekly benefit check and sent directly to the attorney.
A lower rate may be charged by an attorney in certain circumstances. For example, an attorney's representation in Compromise and Release negotiations is often less than 20%.
