It should be noted that in some circumstances employers and their insurance carries obtain an attorney for the injured worker. In these circumstances there may be issues as to whether the attorney obtained by the employer for the injured worker is actually working on behalf of the injured worker or on behalf of the employer. Great care should be taken when entering into a compromise and release agreement; once a case is settled by this method, an individual may not reopen the case.
